Antonio was hired by the wife who wanted to file for divorce in Miami. The main problem with the case was that the husband was missing in action. They had separated several years ago and she had not heard from him since. Mr. Jimenez filed the divorce pleadings in family court and started the service of process. You can't get divorced unless there is a proper service. Meaning the person you want to divorce from has to be on notice that you want a divorce. After attempting without success of obtaining service of process via personal or constructive service at the husband's last known address, he was able to achieve service of process via publication, which for divorces in Florida it is allowed under Chapter 49 of the Florida Statutes (49.021). After service and waiting the required time period for the husband's Answer to the Petition, Mr. Jimenez then filed a Motion for Default becuase the answer was never filed. The default was granted, and the case was then set for a final hearing. At the final hearing the divorce was granted and the client is finally divorced from a man she has not seen in many years and can move on with her life.
